NEW   ODOMETER   CERTIFICATION   LAW

If you sell a vehicle to another individual, you will need to complete the odometer disclosure statement below.  The statement certifies the odometer reading at the time of sale.  The buyer will also be required to acknowledge the odometer reading you certified.  An odometer disclosure statement is not required if the vehicle is:

­      A vehicle that is 10 years old or older

­      Non-motorized, or

­      More than 16,000 pounds (gross vehicle weight rating)

If the West Virginia title was issued after January 1, 1991, the odometer disclosure is required to be completed on the back of the title rather than on a separate disclosure statement.  However, the odometer disclosure is not required to be completed for the above mentioned vehicles.

If you purchase a vehicle from another individual, be sure the seller provides you with a separate odometer disclosure statement.  You will need to submit a copy of the statement to the Division of Motor Vehicles when applying for your title.

Federal and State law require that you state the odometer mileage upon transfer of ownership.  Failure to complete or providing a false statement may result in fines and/or imprisonment.
