Driveways
on Highways
Persons wishing to
construct a new driveway or modify an existing driveway intersecting
a State Highway are required to obtain a permit and to follow
standards that are developed and promulgated by the Division of
Highways.
Permits are available free of charge from any Division of Highways
office. The permitting process prevents uncontrolled access to state
highways that would reduce the roads safety or interfere with
efficient movement of traffic. Unauthorized or nonconforming
driveway installations may result in a fine or removal of the
driveway by Division of Highways employees.
Permits are granted when driveway or approach is for the legitimate
purpose of obtaining access to private property and when the
location, design and construction of the driveway are in accordance
with DOH specifications.
The permit issued by the Division of Highways in no way supercedes
local zoning, building, subdivision or other applicable permits or
ordinances.
